Judgment Affecting Future Claims For Care

The Court of Appeal has recently decided a number of serious personal injury cases involving claims for future care and assistance. Appeals were brought by a number of Defendants against orders for them to make periodical payments for future care. The Court has upheld the view that such care claims should be related to the increase in earnings of care assistants and home carers - rather than the Retail Prices Index. This is good news for claimants, as the result will be more realistic valuations of future care claims. The Court has made it clear that this approach should remain unchallenged and should not be re-opened, unless defendants have new - and more persuasive - arguments to put forward.
